General terms and conditions of business

 

1. Conclusion of contract and user account
1.1. As a service provider, you can register to use the platform free of charge at https://student-freelance.com/.
1.2. By registering on the platform, you confirm that you are authorized to pursue self-employment in Germany and assure that you have the necessary qualifications. You guarantee that you have all the qualifications required for the job (for example cleaning, electricians, gardening and care services).

1.3. You must provide the data required for registration truthfully, in particular your identity, address, telephone number and email address as well as your bank details or credit card, and update them immediately if there are any changes.
1.4. To complete the registration process, click on the button “Confirm your Rentnerminijob account”.
 1.5. Student-freelance will then check your data for completeness and plausibility and inform you by email that you have been successfully included in the data pool. There is no entitlement to inclusion in the data pool.
1.6. As soon as your verification has been successful, you will receive a user name and a one-time password by email, which you can use to log in to the platform via a link.
1.7. The placement contract only comes into effect after the registration process described has been completed and Student-freelance has confirmed your offer in writing.
1.8. You hereby expressly consent to the storage of the personal data you enter.
 1.9. The contract text is not saved by Student-freelance. The current version of these terms of use can be accessed at any time at www.student-freelance,com 

2. Services of Student-freelance
2.1. Student-freelance accepts booking requests for services from end customers by email via the platform and forwards the incoming requests (hereinafter: requests) to you as the service provider. The incoming requests are qualified by Student-freelance, an external call center. 
2.2. Student-freelance carries out a content review and evaluation of the requests in advance and then makes them available to you based on the criteria you have selected.
2.3. A qualified lead may only be passed on by Student-freelance to a maximum of 2 other trades.
2.4. Student-freelance is not obliged to carry out and fulfil contracts for services, but acts as an intermediary in the conclusion of contracts for services. You then carry out the service contract concluded with the end customer under your own organisation and responsibility.
2.5. Student-freelance is not liable - without prejudice to Section 11 - for your breaches of duty as a service provider.

3. Student-freelance portal
3.1. After the contract has been concluded, Student-freelance will provide you with your personal access data for using the tradesmen portal by email.
3.2. In this portal you can view and manage the requests you have booked and change the number of requests and the radius of the requests you have accepted, as well as add additional trades.
3.3. You are obliged to keep your personal access data secret and to prevent its misuse. In particular, passing on the access data to third parties who are not authorized users is considered misuse.
3.4. If there is reasonable suspicion of misuse, Student-freelance must be informed immediately and is entitled to block your access data immediately.

4. Use of the services
4.1. You may use the interfaces and software provided to you by Student-freelance as part of the tradesman portal.
4.2. Any use of the tradesman portal for purposes other than those intended is prohibited. The use of mechanisms, software or scripts in connection with the use of the tradesman portal is prohibited, as is blocking, overwriting, modifying or copying, in particular copying using "robot/crawler" search engine technologies.
4.3. You must also refrain from any action that could impair the functionality of the infrastructure, in particular placing excessive strain on it.
4.4. It is your responsibility to keep a current backup copy of all your content on the tradesman portal or of information sent to the end customer via the tradesman portal, which allows the data to be reconstructed as completely as possible with as little effort as possible in the event of a system failure.

5. Obligations of the service provider
5.1. Student-freelance is not obliged to deliver inquiries.
5.2. The inquiries are made available in the tradesman portal, and you will also receive regular information about your new customer inquiries by email. 5.3
. Student-freelance does not guarantee that the inquiries sent to you will lead to the conclusion of a contract.
5.4. By registering on the tradesman portal, you confirm that you are providing services as part of a properly registered business. As a service provider, you are responsible for the proper payment of taxes and duties.
5.5. You are expressly prohibited from passing on enquiries placed by Student-freelance or passing on data, in particular their commercial resale.
5.6. You are obliged to have the necessary qualifications and permits to fulfil your contractual obligations to the end customer (e.g. entry in the trades register, trade license).
5.7. You are also obliged to always update the contact details you have stored on the tradesman portal.

6. Content, rights of use
6.1. Student-freelance grants you, as a service provider, a non-exclusive, time-limited, non-transferable, non-sublicensable, territorially unlimited right of use for the use of the tradesman portal and the content on the tradesman portal.
6.2. You are prohibited from using protected content such as images, brands, texts, source code, logos of Student-freelance or third parties without permission. This applies to any form of self-presentation on our tradesman portal and in communication with end customers.
 6.3. You grant Minijob Services a right of use limited to the duration of the contract to reproduce, make publicly accessible and distribute the data to be stored by Student-freelance, insofar as this is necessary to provide the services owed under the contract.

7. Agency commission and payment terms
7.1. Student-freelance charges you a commission for arranging inquiries.
7.2. The price per inquiry depends on the order volume. Each inquiry is remunerated according to the current price list. Depending on the trade, the price is 10% gross.
7.3. Unless otherwise agreed, all prices are gross amounts, i.e. plus statutory sales tax.
7.4. Payment is made using the payment method agreed upon conclusion of the contract by bank transfer, advance payment.
7.5. The right to commission arises regardless of whether a contract is concluded with the end customer.
7.6. You may not pass on our commission directly to the end customer, i.e. you may not charge the interested party the commission after contract negotiations have been terminated.

8. Access blocked in the event of a breach of duty
If you violate your obligations with regard to providing truthful information about your data and the obligation to provide evidence of your professional qualifications (sections 1.2 and 1.3) or if you are in arrears with your payment obligations for at least two months (section 7), More at Home is entitled to immediately block your access and/or terminate the contract without notice for good cause.

9. Termination of the contractual relationship
9.1. The contract is for an indefinite period and can be terminated by either party with a notice period of four weeks to the end of the month. Termination must be in writing; an email to the email address kundigung@Student-freelance.com is sufficient.
9.2. In addition, the right to terminate the contractual relationship by extraordinary termination for good cause remains unaffected.
9.3. Student-freelance has good cause to terminate this contract if you violate your obligations as a service provider under sections 1.2, 1.3, 3.4, 4.2, 4.3, 6.2 and 7.6 of the General Terms and Conditions.
9.4. In the event of termination, Student-freelance is entitled to deactivate your user account and irretrievably delete all of your stored data. 9.5
. It is your responsibility to properly back up your data in the event of termination of the contract.

10. Defects and complaints


10.1. You have commissioned a tradesman to carry out a specific job - be it renovating your kitchen or repairing your roof. The agreed date passes and the work is not yet completed. Perhaps the tradesman has not even started the job. In such cases, the client can request the fee paid back on their profile page. Without deductions.
10.2 A tradesman! You have finally received the order confirmation, a date has been set, things will really start soon - but then you have concerns. No matter how or what, you want to cancel the order. Anyone who wants to cancel a tradesman order must expressly declare this cancellation to the tradesman. In such cases, the client can request the fee paid back on their profile page. We will keep the 4% processing fee.
10.3 Once the company has fully provided the service, cancellation is no longer permitted. You cannot cancel.
10.4 Liability. The Student-freelance website is not liable for defective work.

11. Data protection
 Student-freelance stores and processes your personal data in compliance with the applicable legal provisions exclusively for the purpose of fulfilling the placement contract.

12. Applicable law, place of jurisdiction
This contract is subject to the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Hamburg.
